Gebruiksvoorwaarden

VOORWAARDEN VOOR HET GEBRUIK VAN DOOR HET NEDERLANDS INSTITUUT VOOR MILITAIRE HISTORIE (NIMH) VERSTREKT BEELDMATERIAAL

Het persoonlijkheidsrecht (Auteurswet art. 25) bepaalt dat de naam van de maker van een werk moet worden vermeld, zolang het auteursrecht bestaat. Dit persoonlijkheidsrecht kan bij overlijden van de maker ook zijn overgedragen op iemand anders. Naamsvermelding is dus in veel gevallen verplicht. Ook moet de collectie worden vermeld waarin de afbeelding zich bevindt.

Gaat u beeldmateriaal uit de collectie van het NIMH publiceren of op andere manier openbaar maken? Dan gelden hierbij volgende voorwaarden:

  1. Bij hergebruik van het op beeld vastgelegde werk dient de volgende bronvermelding te worden opgenomen: "Collectie: Nederlands Instituut voor Militaire Historie" of “Collectie: NIMH”.
  2. Wanneer de fotograaf/maker van de foto bekend is, dient ook de naam van de fotograaf/maker als bronvermelding te worden opgenomen: Foto: J. Jansen of Foto: Koninklijke Marine.
  3. Het NIMH ontvangt graag een exemplaar van publicaties waarin beeldmateriaal van het NIMH is gebruikt. Dit exemplaar kan verstuurd worden naar het volgende adres: Nederlands Instituut voor Militaire Historie, Postbus  90701, 2509 LS Den Haag.
  4. Als een op het beeldmateriaal vastgelegd werk auteursrechtelijk is beschermd door een andere partij dan het NIMH, mag de gebruiker dat werk niet publiceren of reproduceren voordat de gebruiker daarvoor toestemming heeft gekregen van de auteursrechthebbende. In zulke gevallen zal op de beeldbank duidelijk vermeld staan dat een andere partij de auteursrechthebbende is van het beeldmateriaal. De gebruiker moet zelf toestemming aanvragen. Het NIMH is niet aansprakelijk voor de gevolgen van een verzuim van de gebruiker om toestemming te verkrijgen.
  5. Het is niet toegestaan het beeldmateriaal te gebruiken dat in strijd is met de openbare orde of goede zeden.
  6. Verstrekking van beeldmateriaal aan derden, zonder in achtneming van deze voorwaarden, is verboden.
  7. Van deze voorwaarden kan slechts door het Nederlands Instituut voor Militaire Historie worden afgeweken. Deze afwijking geschiedt schriftelijk.

CONDITIONS FOR THE USE OF VISUAL MATERIAL PROVIDED BY THE NETHERLANDS INSTITUTE FOR MILITARY HISTORY (NIMH)

The personality right (Copyright Act Art. 25) stipulates that the name of the creator of a work must be mentioned as long as the copyright exists. This personality right may also have been transferred to someone else upon the creator's death. Naming is therefore mandatory in many cases. The collection in which the image is located must also be mentioned. Are you going to publish or otherwise make public visual material from the NIMH collection? If so, the following conditions apply:

  1.  When reusing an image, the following source citation should be included: "Collectie: Nederlands Instituut voor Militaire Historie" or “Collectie: NIMH”.
  2. If the photographer/creator of the photograph is known, the name of the photographer/creator should also be included as a source reference: Foto: J. Jansen or Foto: Koninklijke Marine.
  3. The NIMH would appreciate receiving a copy of the publication in which the (audio-)visual material will be featured. This copy may be send to the following address: Netherlands Institute of Military History, Postbus 90701, 2509 LS The Hague, the Netherlands
  4. If a certain image is protected by copyright from a third-party, which is mentioned on the webpage on which the image is featured, usage of any kind is prohibited until the user has obtained permission of a third-party copyright holder. In such cases, the user is responsible for obtaining permission from the copyright holder. The NIMH is not liable for any consequences caused by the neglect of the user for failing to obtain permission from the copyright holder.
  5. It is forbidden to use the material in manners contradictory to public order or common decency.  
  6. It is forbidden to distributre the material to third-parties without enforcement of these general terms and conditions. In case of distribution, one is responsible for upholding the terms and conditions.
  7. For usage of the visual material which differentiate from these general terms and conditions, one must have prior writter permission of the Netherlands Institute of Military History.
